TERMS AND CONDITIONS OF SALE AND USE

These Terms and Conditions of Sale and Use (hereinafter "Terms") govern access to and use of the Site, as well as the sale of the products offered.

Using the Site and ordering products implies full and unreserved acceptance of these Terms.


1. PURPOSE

The purpose of these Terms is:

  • to define the conditions of use of the Site;

  • to set out the rights and obligations of the parties in connection with the online sale of products offered by MM Company to consumers.


2. ACCESS TO THE SITE

Access to the Site is free of charge for any user with Internet access.
The publisher reserves the right to suspend access to the Site for maintenance or any other technical reason.

The user acknowledges the limitations of the Internet and agrees not to attempt to interfere with the operation of the Site.


3. CUSTOMER ACCOUNT (IF APPLICABLE)

Creating an account is not required to place an order.
If the user chooses to create an account, they agree to provide accurate information and keep it up to date.

MM Company may delete any account in the event of:

  • fraudulent use,

  • non-compliance with these Terms,

  • abusive or malicious activity.


4. PRODUCTS

The products offered for sale are described with precision. Photographs are not contractually binding.

All products sold are new.

In the event of unavailability, the seller will inform the customer by email.


5. PRICES

The prices displayed on the Site are expressed inclusive of all taxes, excluding delivery costs.

MM Company may change its prices at any time, but the applicable price is the one displayed at the time of the order.


6. ORDERS

The ordering process includes several steps (selection, customer details, payment, confirmation).

Final validation of the order constitutes an electronic signature and unreserved acceptance of these Terms.

In the event of an error in the address provided by the customer, any additional cost may be charged.

The seller reserves the right to cancel any order for a legitimate reason, in accordance with Article L.121-11 of the French Consumer Code.


7. PAYMENT

Payment is due immediately upon ordering.

The accepted payment methods are indicated on the site (credit/debit card, PayPal, Apple Pay, Google Pay, etc.).

Payment is secured through specialised providers compliant with banking standards.

An order is only considered validated once payment has been confirmed by the banking institution.


8. DELIVERY

Delivery times are indicated at the time of ordering and may vary depending on the destination.

Indicative timeframes:

  • France: 3 to 8 working days

  • Europe: 5 to 10 working days

  • International: 5 to 10 working days

Delivery delays attributable to the carrier or to customs cannot engage the seller's liability.

The customer receives a tracking number as soon as the order is dispatched.


9. RIGHT OF WITHDRAWAL (14 DAYS)

In accordance with Articles L.221-18 et seq. of the French Consumer Code, the customer has 14 days to exercise their right of withdrawal, without justification.

Conditions:

  • Product unused, intact, in its original packaging.

  • Return shipping at the customer's expense (except for defective products).

Refund within 14 days of receipt of the returned product.


10. LEGAL WARRANTIES

Warranty of conformity

Articles L.217-3 to L.217-17 of the French Consumer Code - valid for 2 years.

Warranty against hidden defects

Articles 1641 et seq. of the French Civil Code.

In the event of a defective product, return costs are covered by the seller.


11. LIABILITY

The seller cannot be held liable for:

  • misuse of the product;

  • damage caused by the customer's negligence;

  • temporary unavailability of the Site;

  • force majeure (Article 1218 of the French Civil Code).

The user agrees not to interfere with the proper functioning of the Site and not to use automated data collection processes.


12. INTELLECTUAL PROPERTY

The Site and all of its content (texts, images, videos, logos, trademarks, graphic elements) are the exclusive property of MM Company or its partners.

Any total or partial reproduction is strictly prohibited without prior consent.


13. PERSONAL DATA (GDPR)

The data collected is necessary for:

  • order management,

  • delivery,

  • invoicing,

  • communications with the customer.

MM Company complies with the GDPR and the French Data Protection Act.

The customer has the following rights:

  • access,

  • rectification,

  • erasure,

  • objection,

14. COOKIES

The Site may use cookies to improve the user experience and measure audience.
The customer can manage their preferences via their browser or the consent banner.


15. MEDIATION AND DISPUTES

In the event of a dispute, the customer should contact customer service to seek an amicable solution.

Failing resolution, the customer may refer the matter free of charge to a consumer mediator in accordance with Article L.612-1 of the French Consumer Code.

These Terms are governed by French law.
The French courts have sole jurisdiction in the event of a dispute.
